The data analytics company Equifax was sued for data breaches by around 143 million people to the tune of $5,500 each.

While one Harvard drop out has sued Southwest Airlines for landing his flight in the wrong airport.

This makes suing someone to appear exciting and lucrative. But, that’s not the whole story here.

There are many things you should consider before you go ahead with your lawsuit. Below are the top 5 things you need to think about before you sue someone.

1. Do You Have a Case?

You need to make sure you actually have a case before you sue anyone.

If you were involved in an accident in your local supermarket, it doesn’t necessarily mean that you’re going to be able to make a claim.

Remember, you always have to show that the supermarket owner was at fault and that you incurred damages.

If you don’t have proof of either, you don’t have a case at all.

2. Have You Sent a Demand Letter?

The demand letter is an important precursor before you make a lawsuit. This is also how you show the other party that you’re serious.

You may be surprised by how many organizations and individuals would rather settle the matter rather than go to court.

Consider whether the other party could make a claim against you instead. Is there a compromise which can be found between you.

3. Can you Collect a Judgement if you win?

If you spend a lot of money on your lawsuit, you may find yourself in financial trouble if the other party cannot pay for the damages.

4. Do you Have the Time and Money for the Lawsuit?

If you have been involved in an accident, you need to hire a personal accident lawyer. This will cost legal fees!

You also need to devote a lot of time to the lawsuit if you stand a chance of success. This can be extremely demanding on your bank balance and life.

5. Are you Within Statue of Limitations

You also need to make sure you’re within the period of time whereby you can sue someone. You may have already surpassed the time limit.

6. Where can you Sue?

You need to determine where you can sue someone.

If you want to sue someone from a different state from your own, this wouldn’t be within the jurisdiction of your state. Therefore, you need to be prepared to sue the individual or organization in their own state.
