Four preventable driver decisions, not mechanical failure, poor weather, or random circumstance, sit behind the overwhelming majority of the 39,254 traffic deaths recorded on U.S. roads in 2024, according to a new analysis of federal crash data from Postman Law. The report, drawn from NHTSA’s Fatality Analysis Reporting System, isolates drunk driving, speeding, distracted driving, and failure to wear a seatbelt or helmet as the four dominant behavioral factors behind America’s ongoing road safety crisis, a crisis that also left an estimated 2.42 million people injured in motor vehicle crashes last year.
Drunk driving topped the list, claiming 11,904 lives in 2024, roughly 30% of all traffic fatalities nationwide, meaning approximately one in three people killed on American roads that year died in a crash involving a driver at or above the legal blood alcohol limit. Speeding followed closely, contributing to 11,288 deaths, 29% of the total, while distracted driving accounted for an official count of 3,208 deaths, 8% of fatalities, though the report notes NHTSA’s own data suggests the true toll from texting, calling, and infotainment distraction is likely substantially higher than what’s officially recorded. A failure to wear a seatbelt or helmet was documented in 10,280 driver fatalities, meaning it was a factor in 41.7% of all driver deaths in 2024, the single largest share of any behavioral category examined.
The report also identifies where these behaviors cluster most heavily. When measured by fatality rate per 100,000 residents, Mississippi led the nation by a wide margin at 25.61 deaths per 100,000, more than five times the rate in Rhode Island, the safest state in the country at 4.68. Arkansas (19.66), South Carolina (19.32), and New Mexico (19.13) rounded out the next tier, with Alabama, Wyoming, Montana, Tennessee, Louisiana, and Arizona completing a top ten dominated by rural Southern and Western states. Eight of the ten highest-ranking states share a common profile: high volumes of undivided two-lane highway, comparatively limited traffic enforcement, and longer emergency response times that reduce a crash victim’s odds of survival. Fatality rates per mile traveled run roughly 1.5 times higher on rural roads than in urban areas nationally, a pattern the report says explains much of the geographic clustering.
The report connects these elevated rates directly to gaps in state-level policy. As of 2026, 17 states still lack comprehensive hands-free laws banning all handheld cell phone use behind the wheel, despite evidence that such laws work: Ohio, Michigan, Missouri, and Alabama all reported reduced distraction rates after adopting hands-free legislation, and Colorado saw a 19% drop in inattentive-driving crashes within five months of its 2025 law taking effect. Automated speed enforcement remains similarly limited, available in only 19 states and Washington, D.C. as of mid-2025, meaning speeding in most of the country is deterred almost exclusively by the physical presence of law enforcement officers. Notably, 88% of speeding-related fatalities in 2024 occurred on non-interstate roads, exactly where automated enforcement is rarely deployed, and the states with the highest fatality rates are disproportionately the same states with the weakest enforcement infrastructure.
When fatality rates are measured against vehicle miles traveled rather than population alone, the picture shifts only slightly. Mississippi again ranks highest at 1.81 fatalities per 100 million miles driven, with Arizona (1.74) and South Carolina (1.67) close behind, while states like West Virginia, Nevada, and Kentucky enter the top ten under this measure. The national average sits at roughly 11.49 deaths per 100,000 residents and 1.19 per 100 million vehicle miles traveled, meaning every state in the per-capita top ten fell well above baseline on both counts, with Mississippi’s mileage-adjusted rate running 52% above the national average and Arizona’s 46% above. The report notes this consistency across two different measurement methods, one based on population, the other on actual driving volume, makes clear that the danger in these states isn’t a statistical artifact of how the numbers are calculated.
“These deaths aren’t the product of bad luck, they’re the product of a small set of preventable decisions happening over and over again in places where enforcement hasn’t caught up,” said a spokesperson for Postman Law. “Every one of these four behaviors is something we can measure, predict, and ultimately do something about.”
The report’s authors argue that closing the enforcement gap in high-fatality states, through hands-free legislation, expanded automated speed enforcement, and consistent seatbelt compliance efforts, represents one of the clearest, most immediately actionable paths toward reducing America’s road death toll, given how concentrated the underlying behavioral and geographic patterns already are in the data.
